Tokyo EMS Guide Terms and Conditions

Article 1. Application of Terms and Conditions

The Tokyo EMS Guide (the gGuideh) is created by the EMS Consultation Center Management Group of the Tokyo Medical Association Acute Medicine Committee under the supervision of the Japanese Association of Acute Medicine. The purpose of the Guide is to help the injured or sick people to make their own decisions when they have questions, such as gShould I go to the hospital?h and gShould I call an ambulance?h The Guide is run jointly by the Tokyo Fire Department, which manages its Emergency Telephone Consultation Center, the Tokyo Medical Association, the Bureau of Social Welfare and Public Health, and the Steering Council of the Emergency Telephone Consultation Center (the gSteering Councilh), which consists of the doctors in acute medicine.
@The users of the Guide (the gUsersh) should read and agree with the terms and conditions defined below before they start using the Guide.

Article 2. Changes in Terms and Conditions

The Steering Council reserves the right to modify the terms and conditions without prior notice.

Article 3. Compliance to Terms and Conditions

The Users should strictly comply with the terms and conditions when they use the Guide.

Article 4. Preparation of Appliances, etc.

To use the Guide, the Users should make necessary preparation at their own expense and responsibility. The preparation includes setting up the communication devices, software, and other necessary appliances, and connecting to LAN and the Internet.

Article 5. Management of Tokyo EMS Guide

The Steering Council provides the contents of the Guide free of charge.
The Guide is available 24 hours a day, 365 days a year. However, in case of a natural disaster, an incident, or other emergencies, including the times when such incidents are expected to occur, or in case there is a fault in the electronic communication facilities of the Steering Council or there are other faults or problems, the Steering Council may shorten the service hours of the Guide, or delay, suspend or stop the service.
@The Steering Council claims no responsibility for the damage to the User caused by the above unavailability of the EMS Guide service.

Article 6. Copyright

The contents of this website, including the software, texts and layouts, are protected by the copyright law, and the Steering Council reserves the exclusive right to own them. It is prohibited to copy, transmit, etc. The contents without permission from the Steering Council or to publish or distribute them in magazines or by other means unless the cases are private or explicitly stipulated by the law.

Article 7. Prohibited Actions

The Users must not perform the following actions when they use the Guide:

y1zActions that violate or may violate the intellectual property rights of other Users, third parties, or the Steering Council.

y2zActions that violate or may violate the property or privacy of other Users, third parties, or the Steering Council.

y3zActions that cause or may cause disadvantage, or economical or psychological damage to other Users, third parties, or the Steering Council.

y4zActions that disrupt the management of the Guide.

y5zActions that damage the credibility of the Guide.

y6zActions that use or provide computer viruses or other harmful programs through or on the website of the Guide.

y7zOther actions that violate or may violate the laws or regulations.

y8zOther actions considered inappropriate by the Steering Council.

Article 8. Waiver of Responsibility

y1zThe Tokyo Fire Department, the Tokyo Medical Association, and the Bureau of Social Welfare and Public Health, which organize the Steering Council, are making every effort to provide the accurate information by examining the latest information. However, the Steering Council gives no guarantee that the contents of the Guide are always accurate and perfect at any point of time, because the advice in this Guide is not the result of medical examination or diagnosis, and because medical science continues to develop. Thus, when the Users see the advice of the Guide, they should decide on their own responsibility whether they should go to the hospital or call an ambulance.

y2zThe Guide is designed to be used in Tokyo Prefecture (excluding island areas). Naturally, the advice in the Guide may not be useful when the Users are in the area outside of Tokyo Prefecture, where the medical system and organizations are different from those of Tokyo.

y3zThe Users should acknowledge that the advice in the Guide may be different from that of the Emergency Telephone Consultation Center or the responding ambulance unit.

y4zThe Users should acknowledge that the Steering Council waives all responsibility for the inconvenience, disadvantage or damage caused to the Users by the use of the Guide.

Article 9. Links

y1zThe websites or resources that are linked to the Guide are not managed by the Steering Council; they are run and managed by other companies or individuals. Even if the Users receive any inconvenience, disadvantage or damage by the contents of those websites or by using those websites, the Steering Council waives all responsibility for the inconvenience, disadvantage or damage. The Users should follow the rules of the websites and use them on their own responsibility.

y2zIn general, without permission from the Steering Council, the companies or individuals should not link their websites to the Guide.

Article 10. Governing Law and Jurisdiction

Unless specified, the use of the Guide and the interpretation and application of the terms and conditions are governed by the laws in Japan. Unless specified, the Tokyo District Court has the exclusive jurisdiction over any dispute with regard to the Guide.
